Terms of Service

The short version

  • We're the platform, not the event organiser. Organisers are responsible for their events.
  • Pricing is transparent. Check our pricing page for current rates. Free events cost you nothing.
  • Payouts are manual: Request payouts 7 days after your event.
  • Refund policies are yours to set. If you cancel, you must refund customers.
  • No resale. KwikTix is for selling tickets to your own events only. Resale accounts will be suspended.
  • Don't be dodgy. No fraud, no illegal events. We'll terminate accounts that violate these terms.

Acceptance of Terms

By accessing or using KwikTix ("the Service", "Platform", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and KwikTix. They apply to all users including event organisers ("Organisers"), ticket purchasers ("Customers", "Attendees"), and general visitors to our Platform.

Description of Service

KwikTix provides a software-as-a-service platform that enables Organisers to create, manage, and sell tickets for events. The Service includes:

  • Event creation and management tools
  • Payment processing through Stripe
  • Digital ticket distribution via email and digital wallets
  • QR code check-in system
  • Analytics and reporting dashboards
  • Team member and organisation management

KwikTix acts solely as a technology platform provider. We are not the seller, reseller, or organiser of any events listed on the Platform.

User Accounts and Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password confidential and secure
  • Immediately notify us of any unauthorised access or security breach
  • Be at least 18 years old or the age of majority in your jurisdiction

You are fully responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms or pose a security risk.

Event Organiser Responsibilities

As an Organiser using our Platform, you acknowledge and agree that you are solely responsible for your events. You represent and warrant that:

  • You have all necessary rights, licences, permits, and authorisations to create and sell tickets
  • Your events comply with all applicable laws and regulations
  • All information provided about your events is accurate and not misleading
  • You will honour all ticket sales and provide the event as advertised
  • You will handle all customer service issues relating to your events
  • You will comply with all applicable tax laws
  • You will maintain appropriate insurance coverage for your events

You acknowledge that KwikTix has no control over the quality, safety, legality, or any other aspect of any event listed on the Platform.

Fees and Payment Terms

Platform Fees: KwikTix charges a service fee per paid ticket sold, as displayed on our pricing page. This fee covers platform usage, payment processing, customer support, and technology infrastructure.

Free Events: Events with free tickets incur no platform fees.

Fee Collection: Platform fees are deducted automatically from gross ticket sales before payout.

Payment Processing: All payments are processed through Stripe. By using the Service, you agree to Stripe's terms.

Fee Changes: We reserve the right to modify our fee structure with 30 days' notice to existing users.

Currency Support: We support GBP, EUR, USD, CAD, and AUD.

Payout Terms

Payout Eligibility: Payouts become eligible 7 calendar days after your event date. This holding period allows for processing of refund requests, resolution of payment disputes, and fraud prevention.

Manual Payouts: Payouts are processed manually. You must initiate payout requests through your dashboard once funds become eligible.

Payout Calculation: Your payout equals gross ticket sales minus platform fees, Stripe processing fees, and any refunds issued.

Payout Holds: We reserve the right to hold, delay, or refuse payouts if your account is under investigation, there are unresolved disputes, your event has been cancelled, or you have violated these Terms.

Ticket Sales and Refunds

Refund Policies: Refund policies are set by individual Organisers. KwikTix facilitates refunds but does not determine refund eligibility.

Refund Processing: Refunds are processed back to the original payment method. Processing fees are non-refundable unless required by law.

Event Cancellations: If an Organiser cancels an event, they are required to issue full refunds to all ticket holders.

Chargebacks: In the event of a chargeback, we may deduct the amount from your pending payouts, charge your payment method on file, or suspend your account.

Customers acknowledge that tickets are purchased from the Organiser, not from KwikTix.

Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable laws or third-party rights
  • Create events for illegal activities or prohibited content
  • Engage in fraud, money laundering, or other financial crimes
  • Infringe intellectual property rights
  • Distribute malware or harmful code
  • Attempt to gain unauthorised access to the Platform
  • Use bots, scrapers, or automated tools without permission
  • Create fake or fraudulent events
  • Resell, tout, or redistribute tickets purchased from other platforms or sources
  • Harass, abuse, or harm other users

Violation may result in immediate termination and potential legal action.

No Resale Policy

KwikTix is a primary ticketing platform designed exclusively for event organisers to sell tickets to their own events. The platform may not be used to resell, tout, or redistribute tickets that were originally purchased from other ticketing platforms, box offices, or third-party sources.

Any account found to be engaged in ticket resale, touting, or secondary market distribution will have their account immediately suspended, all associated events removed from the platform, and pending payouts withheld pending investigation. We reserve the right to take additional legal action where appropriate.

This policy exists to protect genuine event-goers from exploitation and to maintain the integrity of the primary ticketing market for legitimate event organisers. If you become aware of resale activity on the platform, please contact our support team immediately.

Intellectual Property

Platform Ownership: The Service and all its content, features, and technology are owned by KwikTix and protected by intellectual property laws.

Your Content: You retain ownership of content you submit. By submitting content, you grant KwikTix a licence to use it for operating the Service.

KwikTix Trademarks: "KwikTix" and related logos are trademarks. You may not use them without permission.

Disclaimers and Limitation of Liability

AS-IS Provision: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, KWIKTIX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

Liability Cap: IN NO EVENT SHALL KWIKTIX'S TOTAL LIABILITY EXCEED THE GREATER OF (A) PLATFORM FEES PAID IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) 100 USD (OR EQUIVALENT IN YOUR LOCAL CURRENCY).

Note: Some jurisdictions do not allow limitation of liability for certain damages. In such cases, our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify and hold harmless KwikTix from any claims arising from your use of the Service, violation of these Terms, your events, or disputes with your customers.

Account Termination

Our Rights: We may suspend or terminate your account for violation of Terms, suspected fraud, excessive chargebacks, or at our discretion.

Effect: Upon termination, pending payouts may be held for up to 90 days and you must honour existing ticket sales.

Your Rights: You may terminate your account by contacting support, provided you fulfill all obligations to ticket holders.

Dispute Resolution

Before formal proceedings, contact us at legal@kwiktix.co to attempt informal resolution. Unresolved disputes shall be resolved through binding arbitration. You agree to resolve disputes individually and waive class action rights.

Governing Law

These Terms are governed by the laws of England and Wales. Legal proceedings will be brought exclusively in courts located in England.

Changes to Terms

We may modify these Terms with 30 days' notice for material changes. Continued use constitutes acceptance.
